By accessing or using zSender, you agree to be bound by these Terms of Service. If you do not agree, do not use the service.

2. Description of Service

zSender is a multi-tenant email-sending platform (an ESP) providing a transactional and marketing email API, domain authentication, sending analytics, and suppression management.

3. User Accounts

You must provide accurate information, keep your credentials and API keys secure, and you are responsible for all activity under your account.

4. Acceptable Use

You may only send email to recipients who have given you permission or for whom you have a lawful basis. You must not use zSender to send unsolicited bulk email (spam), phishing, malware, or unlawful content, and you must honor unsubscribe requests and comply with applicable anti-spam and data-protection laws (e.g. CAN-SPAM, GDPR). Prohibited activity may result in immediate suspension.

5. Service Plans

zSender offers Free and Pro plans. Plan features, sending limits, and quotas are described on our website and may change.

6. Payment Terms

Pro subscriptions are billed monthly through our payment partner Polar. All payments are non-refundable. You may cancel at any time from your dashboard; access continues until the end of the current billing period.

7. Service Availability

The service is provided "as is" and "as available". We do not guarantee uninterrupted availability and may perform maintenance that temporarily affects the service.

8. Data and Privacy

Your use of the service is also governed by our Privacy Policy. You own your data and are solely responsible for your recipient lists and their compliance with applicable law.

9. Intellectual Property

zSender and its software, branding, and content are owned by us and protected by intellectual-property laws. You retain ownership of the content you send through the service.

10. Limitation of Liability

To the maximum extent permitted by law, zSender shall not be liable for any indirect, incidental, or consequential damages, and our total liability for any claim shall not exceed the amounts you paid us in the twelve months preceding the claim.

11. Termination

We may suspend or terminate your account, with or without notice, for breach of these Terms (including abuse or spam). On termination your right to use the service ends; certain provisions survive.

12. Governing Law
